Introduction
This Affiliate Terms of Service (“Agreement”) is made between Romero Multimedia KFT (“Company”, “we”, “us”, “our”) and you, the Affiliate (“Affiliate”, “you”, “your”), collectively referred to as the “Parties”. By participating in the Affiliate Program, you agree to abide by the terms and conditions outlined in this Agreement.
1. Affiliate Program Participation
1.1 Affiliates are eligible to earn a commission rate based on your TIER as outlined in section 7, for traffic directed to Romero Multimedia KFT that results in a sale, as tracked by our affiliate software.
1.2 Affiliates may use our provided trailers, banners, and images for promotional purposes. However, the use of full content for advertisement is subject to additional licensing fees outlined in section 3.
2. Commission and Payment
2.1 Commissions earned by Affiliates are paid upon request, provided all conditions of this Agreement have been met.
2.2 Payment will be issued through the methods specified by the Company, and Affiliates are responsible for any transaction expenses.
2.3 In the event of a breach of the terms outlined in this Agreement, specifically the improper use of full content without appropriate payment of licensing fees, the Affiliate’s balance will be reset to zero.
2.4 Following the settlement of any owed royalties, the Affiliate’s commission rate will be adjusted to 12.5%.
3. Content Use and Licensing
3.1 Affiliates are granted the right to use our trailers, banners, and images for the purpose of promoting Romero Multimedia KFT. Use of our full content for advertising purposes without prior payment of the licensing fee or changing any agreement on the licensing fee is strictly prohibited.
3.2 The licensing fee for the use of our full promotional content in promotional activities is $700 per million views in case of tube sites. For Futanari content, the licensing fee is $900 per million views in case of tube sites. Affiliates opting to use full content in this manner must ensure that view counts are publicly accessible, and will need an agreement with Romero Multimedia KFT.
4. Prohibited Activities
4.1 Affiliates are prohibited from associating Romero Multimedia KFT with any content or keywords that are on the Visa/Mastercard blacklist or deemed illegal or unethical. Failure to adhere to this clause will result in immediate termination of the Affiliate’s participation in the Program, balance reset to zero, and potential legal action.
5. Termination and Consequences
5.1 Romero Multimedia KFT reserves the right to terminate an Affiliate’s participation in the Program at any time for breach of these terms, with immediate effect.
5.2 Upon termination for breach, the Affiliate’s account balance will be reset to zero, and no further commissions will be paid. The Affiliate will also be responsible for paying any owed royalties as estimated by Romero Multimedia KFT.
5.3 Affiliates found to be in violation of section 4.1 will have their payouts suspended and will not be eligible for future participation in the Affiliate Program until all outstanding royalties are settled.
6. Agreement to Terms
By participating in the Affiliate Program, you acknowledge that you have read, understood, and agreed to the terms outlined in this Agreement. This Agreement may be amended by Romero Multimedia KFT at any time. Affiliates will be notified of any changes and continued participation in the Program will constitute acceptance of the new terms.
7. Tiered Compensation Structure
Gold Tier: Affiliates who direct traffic or utilize our trailers without embedding advertisements within our content will qualify for this tier. Compensation for the Gold Tier is 42.5% of initial sales, plus an additional 42.5% on rebills.
Silver Tier: Affiliates who employ our trailers and include advertisements on our content are categorized under this tier. If full scenes are utilized, the affiliate is required to pay royalty fees as specified in Section 3.2 of our agreement. The compensation structure for the Silver Tier is 42.5% of initial sales, plus 12.5% on rebills.
Bronze Tier: Affiliates under this tier have agreed to utilize our content but have opted to modify their payout structure, thereby not adhering to the royalty fee schedule outlined in Section 3.2. The payout for the Bronze Tier is 12.5% of initial sales, plus 12.5% on rebills.
